Immigration offices will be overloaded in the final weeks. Prepare your application now with specialised legal representation.
Non-negotiable administrative criteria to avoid immediate refusals.
To qualify, you must prove you were in Spain before 1 January 2026.
In the general route, you must prove 5 uninterrupted months in Spain immediately before applying. You can use public or private documents (or a combination) that identify you and are dated.
You must have no criminal record in Spain and in countries of residence over the last 5 years. Foreign certificates must be properly apostilled. Legal exception: if you prove 5 continuous years in Spain, you may not need to provide certificates from your country of origin.
If you applied for asylum before 1 January 2026, you may qualify. You will not need to prove the 5 months. Filing suspends deadlines in your international protection process while residence is decided.
If you did not apply for asylum, in addition to the 5 months, you must meet just one of these three requirements:
You don’t have to wait months. Once your application is admitted, you receive a provisional authorisation to live and work (employed or self-employed) across Spain, typically effective within 15 days.
The process protects families. If you apply simultaneously for your minor children, they are exempt from standard financial means and are expected to receive a 5-year authorisation.
If you have an expulsion/devolution procedure for irregular stay (art. 53.1 a and b), granting this authorisation means the case is archived and the order is revoked.
NGOs and unions may file applications for free, but with hundreds of thousands of people, a collapse is likely. As electronic representatives under Law 39/2015, our law firm files your case online immediately and builds legal strategy around your evidence to avoid refusals.
The deadline is non-extendable and ends on 30 June 2026. Apply as early as possible to avoid administrative overload in the final weeks.
Yes. If you applied for asylum before 1 January 2026, you may qualify. Filing suspends deadlines in your international protection procedure while residence is decided.
You can use public documents (municipal register, health system, reports) or private ones (remittances, contracts, receipts) that include your personal data and a date showing your presence in Spain.
Once your application is admitted for processing, you receive a provisional authorisation to live and work (employed or self-employed), typically effective within about 15 days.
If it can be cancelled due to time, the process allows cancellation. If you prove you have lived continuously in Spain for the last 5 years, you may not need to provide criminal record certificates from your country of origin.
